Remember that workplace dress codes must apply equally

As an employer, it is understandable that you may want to institute a uniform policy or a dress code in the workplace. At the same time, your employees may be unhappy about this change and contest the policy.

From a legal perspective, one of the most important things to remember is that the dress code should not be discriminatory. It needs to apply equally and fairly to all employees, and it is crucial to consider how the dress code may affect employees who are in certain protected classes.

Potential areas for discrimination claims

One key area where workers will sometimes contest that the dress code imposes an unequal burden is that of sex or gender. For instance, you should not institute a dress code that applies only to female workers, but not male workers. The dress code should apply equally to all and should not unequally enforce gender norms.

Similarly, religious beliefs can sometimes be violated by a dress code. This can happen even when that dress code applies to everyone.

For example, perhaps you do not want to allow head coverings in the workplace. You make a dress code policy stating that all workers, regardless of their religion, are prohibited from wearing head coverings. This may appear equal, but the reality is that it is only going to affect workers who follow a religion where head coverings are part of their required attire. They may still claim that this is discriminatory and that the dress code has been set up to target them specifically.

Setting up a policy or navigating a dispute

If you keep the general doctrine of equal and fair application in mind when instituting a dress code, the policy will likely not create any legal issues. That being said, if disputes and conflicts do arise, or if you face legal challenges from your employees, it is critical that you know what steps to take and what options you have.
