DFEH Makes New Mandatory Transgender Rights Poster Available

Starting January 1, 2018, all California employers will be required to display a new workplace poster related to transgender rights. Governor Jerry Brown's recently signed Senate Bill 396, requires that the poster be posted in a prominent and accessible location in the work place.

Recently, the Department of Fair Employment and Housing [DFEH] published the English and Spanish language versions of the mandatory poster. The English version of the poster can be downloaded here: https://www.dfeh.ca.gov/wp-content/uploads/sites/32/2017/11/DFEH_E04P-ENG-2017Nov.pdf and the Spanish version can be downloaded here: https://www.dfeh.ca.gov/wp-content/uploads/sites/32/2017/11/DFEH_E04P-SP-2017Nov.pdf Additionally, the DFEH will be creating Chinese, Korean, Tagalog and Vietnamese versions of the poster shortly.

Furthermore, the DFEH mandates that any DFEH poster be conspicuously displayed where it can be read by all employees and job applicants and if ten percent or more of a company's workforce speaks a language other than English a poster must be displayed in that language.

An employer can also purchase posters from other providers, and many provide an all-in-one poster that contains all required notices. However, the downloadable notices posted above provide a quick and easy route to ensure your business complies with the new SB 396 requirements.

If you have any questions or concerns about your business complying with the slate of new requirements for 2018, please contact your Sagaser Watkins and Wieland attorney at 559-421-7000.
